The State demonstrates its power

The Capital City Court affirmed the primary court’s decision to Nambar Enkhbayar, the former President of Mongolia, the Head of the Mongolian People’s Revolutionary Party /MPRP/. The final decision was introduced by Sukhbaatar District Court of Capital City on September 26, 2012.

Despite the demonstrations and other activities organized by the supporters of the MPRP and even the famous lawyer S. Narangerel’s effort in order to defend their leader N. Enkhbayar, the Capital City Court affirmed the primary court’s decision, according to the rule of law. It means that the General Judge of Sukhbaatar District Court, N. Soyombe-Erdene’s decision was fair, who has been blamed by the MPRP supporters.

The Member of Parliament Z. Bayanselenge along with the MPRP supporters organized demonstration where she protested Sukhbaatar District Court’s decision, few months ago. But her protest has never influenced Capital City Court to make correct decision and the Mongolian judicial institutions proved its independence. This decision has become the clear example of that the Mongolian legal reform has already begun being implemented.

The former President’s case was at the center of attention and the Court convinced people that the rule of law became applicable to all the people equally, by its decision.

High profile state officials have never been convicted corruption and punished by the Court, in Mongolia. The people used to think that the officials have special permission to take much bribes as they can, escaping legal responsibilities. But the latest Court decision has changed public opinion. The Court made decision, no matter who is the defendant, the former President of Mongolia or an ordinary Mongolian citizen. The Court decision has changed people’s thought that the authorities and their relatives have full immunity from legal prosecution.

It is no doubt that N.Enkhbayar’s party members put their hope in next Court hearing. But the people expect from the Court fair decision, such as previous ones and judiciary will prove its independence once again. We often hear news about foreign heads of state and government leaders, who have been convicted of serious financial crimes. The people of Mongolia were lamenting over the Egyptian former dictator Hosni Mubarak, when he was taken to the Court. The number of people convinced that the former President N.Enkhbayar is innocent. Mongolians are very kind hearted and compassionate people and tend to feel sorry for everyone who suffers.

But, everyone has equal rights and no one is above the law. Accordingly, the state demonstrates its power through Court’s decision and people should have to respect it.
